Letter: March, 2007 Hon: Jon Corzine, Governor, State of New Jersey Office of the Governor PO Box 001 Trenton, NJ 08625 609-292-6000 Email: cc: DEP Officials commissioner@dep.state.nj.us john.watson@dep.state.nj.us john.flynn@dep.state.nj.us David.Smith@dep.state.nj.us Dear Governor Corzine: In January 2007, in a detailed and comprehensive application, the Borough of Fair Haven formally submitted to the State Department of Environment Protection (DEP) a proposal for a land diversion in which it offered to provide a larger piece of property that would be integrated within Fair Haven Fields (open space in the Borough) for a much smaller piece of property in Fair Haven Fields that it proposed would be used as a site for a cell tower in Fair Haven. In addition, the Borough committed to dedicate all funds generated from a cell tower located in Fair Haven Fields to recreation and park maintenance. In a meeting between Fair Haven Borough officials and DEP officials on February 23, 2007, the DEP denied this application. The Borough’s proposal is, in fact, a clear ‘win’ for Open Space. We feel the DEP did not act in a responsible way, nor show concern for the long-term health of the residents Fair Haven or the environment, since the other possible cell tower locations under active consideration are considerably closer to homes and schools, and would cause significantly more disturbance to the environment. Apparently, the DEP is not looking to protect the environment, but rather to protect itself from potential litigation. Furthermore, the DEP did not act in the general public interest. The Borough’s proposal clearly would add more recreational land and saved trees. Isn’t this what the DEP is chartered to? Fair Haven is very fortunate in that its governing body has listened to the concern of its residents in making a fundamental requirement that a cell tower site be suitably distant from homes or schools in the Borough. We stand behind our Mayor and our Borough Council in their recommendations. We ask that you investigate the matter, and overrule the actions of the DEP and grant the Land Diversion application.
